Terms of service
1. About these terms
These terms apply whenever you buy from Gifts by Emily, a personal gifting service run by Emily O'Byrnes, trading as Gifts by Emily, Sutton, Dublin 13, Ireland. Contact us at hello@giftsbyemily.com.
By placing an order you agree to these terms. They do not affect your statutory rights as a consumer under Irish law. Our privacy policy explains how we handle your information.
2. Our services
We research and recommend gifts. Each brief gets three ideas, each with a link to buy and the reasons it suits the person.
| Plan | What you get | When |
|---|---|---|
| Single Gift | One brief, three gift ideas | By the end of the next working day, if your brief and payment arrive before 2pm (Monday to Friday, excluding Irish public holidays) |
| Gift Calendar | Up to five dates a year, a reminder three weeks before each, and three ideas per date | Ideas within one working day of your brief |
| Concierge | Up to ten gifts a year. We choose, buy, wrap and send each gift from your prepaid gift budget | We contact you three weeks before each date |
Our ideas are recommendations. You decide whether to buy, and you buy directly from the retailer, except under Concierge. Concierge places are limited, and we may close Concierge to new customers at any time.
3. Prices, payment and renewals
Prices are in euro and shown on our pricing page. We are not registered for VAT, so no VAT is added.
- Single Gift (€39) is a one-off payment, taken after you submit your brief.
- Gift Calendar (€149 a year) and Concierge (€449 a year) are annual plans. They renew automatically each year. We email you at least 30 days before renewal, and you can cancel any time before it by emailing us.
- Concierge gift budgets are separate from the plan fee. They are paid in advance and held for your gifts only (section 5).
Payments are processed securely by our payment provider. We never see or store your full card details. If we change our prices, the change applies from your next renewal, and we tell you in the renewal reminder.
4. Revisions, refunds and your right to cancel
Our service is expert advice, delivered as soon as it is ready. If the ideas miss the mark, we put it right with fresh ideas rather than refunds.
Free revision. If none of your three ideas feels right, reply within 14 days telling us what missed. Emily will send three new ideas within two working days, at no cost.
No refunds once ideas are delivered. Gift ideas can be used the moment you receive them, so we do not refund a brief once its ideas have been delivered. This does not affect your statutory rights.
Your 14-day right to cancel. Under Irish and EU law you can cancel an online purchase within 14 days of paying, with these conditions:
| Plan | If you cancel within 14 days |
|---|---|
| Single Gift, ideas not yet delivered | Full refund |
| Single Gift, ideas already delivered | No refund. When you order, you ask us to start straight away and agree that your right to cancel ends once your ideas are delivered |
| Gift Calendar | Refund of the fee, less €29.80 for each set of ideas already delivered |
| Concierge | Refund of the fee, less €44.90 for each gift already chosen, plus your full unspent gift budget |
After 14 days, you can cancel Gift Calendar or Concierge at any time to stop it renewing. Your plan stays active until the end of the year you paid for, and the fee for that year is not refunded. Any unspent Concierge gift budget is always refunded.
If we get it wrong. If we fail to deliver your ideas, or do not provide our service with reasonable care and skill, we will put it right or refund you, as the law requires.
To cancel, email hello@giftsbyemily.com. Any refund is made to your original payment method within 14 days.
5. Concierge gift budgets and deliveries
Your gift budget is your money, spent only on your gifts, and anything unspent comes back to you.
- Approval first. Three weeks before each date, we send you the gift we plan to buy and its cost. We buy only after you approve it, or after 3 working days without a reply if you have told us in advance to go ahead.
- Budget records. We keep your budget separate from our own money and send you a statement after each purchase showing what was spent and what remains.
- Buying for you. We buy each gift on your behalf from the retailer, including the retailer's wrapping where offered, and have it sent to the address you give us. Delivery times are the retailer's.
- Returns and faults. Returns follow the retailer's own policy. If a gift arrives faulty or damaged, tell us within 7 days of delivery and we will handle the claim with the retailer for you.
- Unspent budget. Refunded within 14 days of your plan ending or being cancelled. We never charge fees on your budget.
6. Products from other retailers, and our liability
We recommend products sold by other shops, so the shop, not us, is responsible for the product itself.
- Prices and stock are checked when we send your ideas but can change afterwards. We cannot guarantee a product will still be available or at the same price when you buy.
- Your purchase is a contract between you and the retailer, under the retailer's terms, delivery times and returns policy. Under Concierge, we act on your behalf in that purchase.
- We are responsible for providing our service with reasonable care and skill, as Irish law requires. If we fall short, our liability is limited to the fees you paid us for the affected brief or plan year, plus any Concierge budget we mishandled.
- We are not responsible for how a recipient feels about a gift, for retailer errors or delays, or for losses we could not reasonably foresee. Nothing in these terms limits liability that cannot be limited by law.
7. Your part, complaints, and the law
Your part. Please give us accurate details in your brief, including dates, sizes and delivery addresses. Share only information you are comfortable with the recipient knowing we hold. We cannot be responsible for ideas that miss because of incorrect information, though we will always try to help.
Complaints. Email hello@giftsbyemily.com and Emily will reply within 2 working days. If we cannot resolve it, you can contact the Competition and Consumer Protection Commission at ccpc.ie.
Changes. We may update these terms. Changes apply to orders placed after the update, and to plans from their next renewal.
Law. These terms are governed by Irish law, and the Irish courts have jurisdiction. If you live elsewhere in the EU, you keep the protections of your own country's consumer law.
